This End User License Agreement ("Agreement") is a legal agreement between you ("you" or "User") and Blue Guard Innovations, LLC ("Blue Guard Innovations", "we", "us", or "our") governing your use of our website, online store, and any related software or services we operate (collectively, the "Service"). By accessing or using the Service, you agree to be bound by this Agreement. If you do not agree, do not use the Service.
1. License Grant
Subject to your compliance with this Agreement, Blue Guard Innovations grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes. No other rights are granted, whether by implication, estoppel, or otherwise.

8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. BLUE GUARD INNOVATIONS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUE GUARD INNOVATIONS, ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR ONE HUNDRED U.S. DOLLARS (USD 100).
10. Indemnification
You agree to defend, indemnify, and hold harmless Blue Guard Innovations, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of this Agreement, or your violation of any rights of a third party.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated this Agreement. Upon termination, the license granted in Section 1 immediately ceases. Sections 2, 8, 9, 10, 12, and 13 survive termination.
12. Governing Law and Venue
This Agreement is governed by the laws of the State of Arizona, USA, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to this Agreement or the Service will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.
13. Changes to This Agreement
We may modify this Agreement from time to time. Material changes will be posted to our website with an updated "Last updated" date. Your continued use of the Service after the effective date of any change constitutes acceptance of the revised Agreement.
14. Entire Agreement
This Agreement, together with our Privacy Policy and any other policies referenced on our website, constitutes the entire agreement between you and Blue Guard Innovations regarding the Service and supersedes any prior agreements relating to the subject matter.
